Terms of Service
Last updated 25 October 2026
Settle is operated by Equinox Co Pty Ltd (ACN 702 166 167, ABN 17 702 166 167), New South Wales, Australia. In these terms "we", "us" and "our" mean Equinox Co Pty Ltd. "You" means the person or business using Settle.
These terms are the agreement between you and us for the Settle iPhone app, the Settle web app, this website and the Copilot inside the app. By creating an account or using Settle you agree to them. Our Privacy Policy explains how we handle your information and is part of this agreement.
In plain English
- 1You need to be 18, using Settle for a business, and responsible for your login.
- 2Every feature is on every plan. Plans differ only in seats, the AI allowance and the jobs Settle does on autopilot.
- 330 days free with a card up front. Cancel before it ends and you pay nothing.
- 4Prices are in Australian dollars. We are not registered for GST, so we add none. A year costs the same as ten months.
- 5Plans renew on their own until you cancel. Cancel any time; you keep access to the end of the period you paid for.
- 6We give 30 days' notice of any change to prices or these terms, and you can cancel before it applies.
- 7Money from your clients goes to your own Stripe account. You are the merchant; we are not a party to those payments.
- 8Your data is yours. We hold a licence only to run the service for you.
- 9Your Australian Consumer Law rights stay. Beyond them, our liability is limited.
- 10Talk to us first about any dispute. After that, the courts of South Australia.
1. Who can use Settle, and your account
You must be at least 18 and using Settle for a business, whether that is your own or one you work for. If you sign up for a business, you confirm you are allowed to bind it to these terms.
You are responsible for your account: keeping your login private, the accuracy of what you enter, and everything done under it. If you think someone else has access, tell us straight away.
Crew members you add get their own login to the parts of your business you give them. You are responsible for who you add and what you let them see.
2. What Settle is
Settle is software for running a trade business: quotes, jobs and scheduling, crew hours, receipts and expenses, invoices, getting paid through your own Stripe account, and the Copilot. It runs on iPhone and on the web.
Every feature is on every plan. Plans differ only in how many seats are included, the size of the monthly AI allowance and which jobs Settle does for you on autopilot. Section 3 sets them out.
Settle keeps records and does sums. It is not accounting, tax, legal or payroll advice, and you remain responsible for your own obligations, such as tax, superannuation and award rates.
3. Plans and prices
Prices are in Australian dollars. We are not registered for GST, so we charge none and our receipts are not tax invoices. If you subscribe in the iPhone app, Apple sells you the subscription and its price includes any tax Apple collects. A yearly plan costs the same as ten months. These are the current plans:
| Plan | Monthly | Yearly | Seats included | AI each month |
|---|---|---|---|---|
| Solo | $39 a month | $390 a year | 2 seats | Everyday AI allowance |
| Team | $99 a month | $990 a year | 6 seats | 2.5× Solo's AI |
| Business | $199 a month | $1,990 a year | 10 seats | 5× Solo's AI |
| Enterprise | By arrangement. Talk to us. | |||
A seat is a person who can log in. When you subscribe on the web you can add seats beyond the ones included, at $7 a month each or $70 a year each, billed with your plan. Extra seats are not sold through the App Store.
The AI allowance is monthly, shared by everyone on the account, and does not carry over. A free trial runs on Solo's allowance; a plan's full allowance starts when its trial ends. The pricing page explains what the allowance covers.
If you subscribed at an earlier price, you keep that price. Section 6 covers any change to it.
Enterprise is priced for you and set out in a separate written agreement. Where that agreement and these terms differ, that agreement wins.
4. The free trial
New accounts get a 30-day free trial of the plan they choose. You give a card, or an App Store payment method, when you start. You are not charged during the trial. When the 30 days end, the plan starts and the first payment is taken, unless you cancelled before then.
One trial per person or business. We can end a trial early if it is being used to get around that.
5. Billing, renewal and cancellation
Two ways to pay
If you subscribe in the iPhone app, Apple bills you through your App Store account, and your subscription is also subject to Apple's terms, including its standard Licensed Application End User License Agreement. Apple manages the trial, renewal, cancellation and refunds for those subscriptions, and we cannot change them on your behalf.
If you subscribe on the web, Stripe processes the payment by card for us. You can change your plan, add seats, update your card and cancel from Manage subscription on the Plans screen.
Renewal
Your subscription renews automatically at the end of each month or year, at the price then current, until you cancel. We send a receipt for each payment.
Cancelling
You can cancel at any time. Your plan stays active until the end of the period you have already paid for, then stops. We do not refund the unused part of a period, except where the Australian Consumer Law or Apple's terms require it, or where section 6 gives you the right to cancel because of a change we made.
Missed payments
If a payment fails, Stripe or Apple retries it and you keep access while they do. If it still fails, your subscription lapses and the app asks you to subscribe again before you can keep working. We do not delete your data because of a lapsed subscription; section 14 covers deletion.
6. Changes to prices or these terms
We do not change prices or these terms without telling you. If we intend to raise a price or change these terms in a way that affects you, we will email you at least 30 days before the change applies. During that time you can cancel, and if you do, the old price and terms apply until your current period ends. If you keep using Settle after the change applies, the new price or terms apply from your next renewal.
A change that only benefits you, or a correction that does not change your rights, may apply straight away. We post every version of these terms here with its date.
Price changes for App Store subscriptions are handled by Apple, which asks you to agree before a higher price is charged.
7. Payments from your clients
When a client pays an invoice through a Settle payment link, the money goes to your own Stripe account, which you set up inside Settle. You are the merchant of record for those payments. We are not a party to the sale, the payment or any refund or dispute about it.
Your Stripe account is governed by the Stripe Connected Account Agreement and the Stripe Services Agreement. Stripe's fees apply to each payment and are set by Stripe. We take no percentage of your client payments.
Payouts, chargebacks, refunds and identity checks are between you, your client and Stripe. We will help you find the right screen, but we cannot move money on your behalf.
You are responsible for the accuracy of every quote and invoice you send, including GST, and for having the right to charge what you charge.
8. Your data
Everything you put into Settle is yours: your clients, quotes, jobs, invoices, photos, notes and records. You give us a licence to store, copy, process and transmit it, only as needed to run Settle for you, to provide support you ask for, and to meet the law. That licence ends when the data is deleted.
You can export expenses and timesheets as CSV from the app, we will give you a copy of the rest of your data on request, and you can delete your account from inside the app. The Privacy Policy explains exactly what happens when you do.
You are responsible for the data you enter, including having the right to hold other people's details and for telling your clients and crew how you use them.
Settle itself, including its design, code, name and the Copilot, belongs to us and our licensors. These terms give you a right to use it while you have an account, not ownership of it.
9. Your responsibilities and acceptable use
Use Settle for your own business and within the law. You must not:
- use it to send spam, or messages a client has asked you to stop sending;
- enter information you have no right to hold, or use it to harass, defraud or mislead anyone;
- try to get into another account, probe or overload the service, or work around limits such as seats and allowances;
- copy, resell, reverse engineer or build a competing product from it;
- use it in a way that puts us in breach of a provider's terms, such as Apple's or Stripe's.
If you break these rules we may suspend or close your account under section 14.
10. The AI in Settle
The Copilot, Smart Quote, receipt reading and the daily brief use AI models to read your data and to draft or do work you ask for. They can be wrong. Check any figure, name or date before you rely on it, and treat a draft as a draft.
The Copilot does what you ask it to and shows every change on a card, with Edit beside each one and an Undo that takes back what it made, except anything you have since sent, billed, edited or built on. Check the card before you rely on the work. The Copilot never sends anything to a client on its own. It can get an invoice, a quote or a payment reminder ready to email to the client on that document, and the email goes only when you tap Send on its card. The Copilot never deletes a record you made, never moves money and never changes your plan.
AI features use your plan's monthly AI allowance (section 3). When it runs out for the month, AI features wait until the next month, or you can move to a plan with more.
Our Privacy Policy explains which providers process your data for these features.
11. Connected services
You can connect Xero, QuickBooks and Google Calendar, and you use Stripe and the App Store as described above. Each of those is a separate service under its own terms. We are not responsible for them, for changes they make, or for what happens to your data once it is on their side. You can disconnect them from Settle at any time and revoke the access on their side.
12. Availability and changes to the service
We work to keep Settle up and fast, and we take backups. We do not promise a particular uptime, and Settle may be unavailable for maintenance, because of a provider outage, or for reasons beyond our control. Where we can, we tell you about planned maintenance in advance.
We improve Settle all the time. We may add, change or retire features. If we retire something you rely on, we will tell you at least 30 days beforehand and section 6 applies.
13. Australian Consumer Law and our liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other law that cannot be excluded. Those rights include that services are provided with due care and skill, are fit for their purpose and are delivered within a reasonable time.
Where the law lets us limit our liability for a failure to meet a consumer guarantee, and Settle is not of a kind ordinarily acquired for personal, domestic or household use, our liability is limited, at our choice, to supplying the services again or paying the cost of having them supplied again.
Apart from those rights, and to the extent the law allows:
- Settle is provided as is, and we do not promise it will be error free or suit every business.
- We are not liable for indirect or consequential loss, loss of profit, business or data, or for loss caused by a third-party service, by your own use of the data, or by something outside our reasonable control.
- Our total liability to you under these terms in any 12 months is limited to the amount you paid us in those 12 months.
You are responsible for keeping your own records as the law requires, including exporting from Settle when you need to.
14. Ending this agreement
By you
You can stop using Settle at any time. Cancel your subscription (section 5) and, if you want your data gone, delete your account from inside the app. Deleting your account is immediate and permanent.
By us
We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or if a payment stays unpaid for 60 days after we have told you. Except where we need to act at once to protect the service or other people, we will tell you first and give you a chance to fix the problem.
If we stop offering Settle altogether, we will give you at least 60 days' notice and refund any part of a period you have paid for but will not receive.
Your data when it ends
If your subscription lapses, your data stays where it is and you can subscribe again to pick up where you left off, or ask us for a copy. If we close your account, we give you at least 30 days to get a copy of your data first, unless the law prevents it. Once an account is deleted, whether by you or by us, the data is gone as the Privacy Policy describes.
Sections 7, 8, 13, 15 and 16 continue after this agreement ends.
15. Disputes and governing law
If something has gone wrong, email us first at hello@settleapp.com.au. We will acknowledge you within 5 business days and work with you in good faith to sort it out within 30 days. Most problems end there.
If we cannot resolve it, either of us may take it to a court. These terms are governed by the laws of South Australia, and you and we agree to the courts of South Australia and any court that hears appeals from them. Nothing in this section stops you from using a consumer protection body or a tribunal that the law gives you access to.
16. General
- These terms, the Privacy Policy and any written Enterprise agreement are the whole agreement between you and us about Settle.
- If a part of these terms is found unenforceable, the rest still applies.
- If we do not enforce a right straight away, we have not given it up.
- You may not transfer this agreement to someone else without our written consent. We may transfer it to a successor who takes over Settle, and we will tell you if we do.
- We send notices to the email address on your account. You send notices to the address in section 17.
- Apple is not responsible for the app or for these terms, and may enforce them against you as a third-party beneficiary in relation to the iPhone app.
